ACCEPTANCE OF TERMS
By accessing or using the Site or the Services, or by clicking to accept these Terms when this option is made available to you, you accept and agree to be bound by these Terms. In addition to these Terms, your access to and use of certain portions or aspects of the Site, or your ability to access and/or use certain Services, may require you to accept additional terms and conditions, including, without limitation, SOLDIERFIT standard membership policies and any applicable membership agreement(s) and/or waiver(s) for your applicable studio(s) (collectively, “Additional Terms”). The Additional Terms are hereby incorporated and made a part of these Terms by this reference.
THESE TERMS GOVERN YOUR ACCESS TO AND USE OF THE SITE AND THE SERVICES. BY USING THE SITE AND/OR ANY OF THE SERVICES, YOU EXPRESSLY AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SITE OR THE SERVICES.
ASSUMPTION OF RISK
I understand that SOLDIERFIT’s training involves regimens of highly strenuous athletic and physical fitness activities. I recognize that participation in such activities inherently involves health and injury risks, which can be very serious, including death. I understand and knowingly accept and assume all health injury risks, including death. I represent that I have no physical or health issues that might inhibit my participation in training or might increase my risks. I further represent that I have recently received medical clearance and approval from a physician to participate in highly strenuous exercise activities. I understand that it is my responsibility to regulate the scope and intensity of my participation in each class session so that I am not overtaxed and I promise that I will do so. I further acknowledge that, by electing to continue participation in class, my assumption of risk will be ongoing and absolute. Lastly, I acknowledge that any failure on my part to exercise prudence may significantly increase the risks I will incur.
WAIVER OF LIABILITY
I hereby release in full and forever discharge and hold harmless SOLDIERFIT®, its fitness instructors, agents, officers, and employees, whether acting within the scope of their employment or otherwise, from any liability, losses, costs, damages, expenses, claims, or lawsuits whatsoever for any or all injuries, losses, illnesses, harms, costs, expenses, claims, suits, or other damages resulting from, related to, or in any way arising from my participation in SOLDIERFIT® classes. I understand that the owner of and agent for any property where my class is conducted and/or any class sponsor will also be a beneficiary of this Waiver of Liability and Release.
LIABILITY FOR PERSONAL INJURY OR DEATH
SOLDIERFIT® will not be held liable for any personal injury, death, or damage to personal property sustained during participation in any classes or use of the gym facilities. Members acknowledge that participation in fitness activities carries inherent risks, and they voluntarily assume all risks associated with such activities.
CONDUCT
In the event that a member fails to conduct themselves in accordance with the agreed-upon behavior in this agreement, SOLDIERFIT® shall not be liable for any resulting injury, loss, or damage.
Class Reservations
Members must sign in for class/gym using the SOLDIERFIT app before entering a workout and must have their picture uploaded for ID purposes.
Uniform Policy
Members are required to be in uniform for all Bootcamp classes.
Guest Policy
Members may invite guests (limit one visit per guest), and the guest must be booked ahead of time to be entered into class.
COLLECTION
In the event it becomes necessary to employ a collection agency or attorney to collect any monies due under the terms of this agreement, the member agrees to pay all costs, including reasonable attorney fees.
BAD CHECKS/DEBITS
Members agree to pay a $20 service fee for each bad check or bad debit.
Termination for Cause
SOLDIERFIT® reserves the right to terminate any member, for cause, without refund. If any portion of this agreement is deemed invalid, the remaining portions will remain intact.
Billing Cycle
I understand that my payments are arranged to be billed every 4 weeks (28-day billing cycle) or in some cases every 1 week (7-day billing cycle) and are not affected by my attendance. This agreement requires that lessons be paid for regardless of whether classes are taken.
Discounted Memberships
I understand that if I receive a discounted gym membership by being a SOLDIERFIT® basic training or PT member, and if I cancel my SOLDIERFIT® basic training or PT membership, my gym dues will increase to the current standard monthly rates determined by SOLDIERFIT®.
Compliance with Rules
I acknowledge that I have received and comply with the rules and regulations of SOLDIERFIT®. I understand that I must complete the length of this contract, after which my membership will continue on a month-to-month basis under the same terms until I cancel it. Cancellation notice, once I have met the terms and continue M2M, must be received in writing at least 28 days prior to the next billing date, or I will be responsible for an additional month of dues. I may cancel this agreement without penalty or further obligation within three (3) days of purchase for a full refund. I may also cancel this agreement in the case of serious illness or injury (doctor’s note required) or in the case of a move 15 miles or more from any SOLDIERFIT® location. Proof of move, such as a mortgage, lease, or driver’s license, is required. A 5-day written request prior to the bill date is required for a medical termination and must be supported with a doctor’s note, or I will be billed for an additional month of dues. The Early Termination Fee will be three (3) months of membership dues (paid upon cancellation) when proper documentation is not provided per the terms agreed upon, as stated above.
Membership Freeze
I may freeze my membership up to 90-days a year or during medical disability. Requests must be accompanied by a doctor’s note 10 days prior to my bill date, or the freeze will be applied to the following month and the current month’s payment will be billed. By placing my membership on freeze, I understand that this extends my expiration date. During the freeze, a $20 Inactive Reserve Fee will be assessed to every 4-week scheduled bill date that falls within the freeze period.
Non-Transferable Membership
I understand that my membership is non-transferable unless otherwise approved by SOLDIERFIT®, in which case a $50 transfer fee will be assessed.
Use of Name and Likeness
I hereby give permission to SOLDIERFIT® to use my name and photography likeness in all forms and media for advertising, trade, and any other lawful purposes.
Guest Waiver
All guests participating in SOLDIERFIT® classes or events must sign a waiver before attending. Guests are subject to the same risks and assumptions outlined in the Assumption of Risk and Waiver of Liability sections and must represent that they are medically cleared to participate in strenuous physical activity.
Photography/Videography Policy
Members and guests may take photos and videos for personal use during classes, provided they do not disrupt the class or infringe on the privacy of others. SOLDIERFIT® may capture photographs and videos of members for promotional purposes. By participating in SOLDIERFIT® activities, you consent to being photographed or recorded and to SOLDIERFIT® using your likeness for marketing and promotional purposes.
Modification of Terms
SOLDIERFIT® reserves the right to modify these Terms at any time. Any changes will be communicated to members through email and posted on the SOLDIERFIT® website. Continued use of SOLDIERFIT® services following any changes constitutes acceptance of the revised Terms.
Refund Policy
All membership fees, memberships, pre-paid & paid in full, class purchases, retail items are non-refundable, except in cases of medical termination (with a valid doctor’s note) or relocation outside of a SOLDIERFIT® service area, as specified in this agreement. In cases of service disruption due to unforeseen circumstances, SOLDIERFIT® may choose to provide membership freezes or extensions at its discretion.
Class Participation and Conduct
Members are expected to participate in classes in a manner that respects the instructor, other participants, and the SOLDIERFIT® environment. Disruptive behavior, inappropriate conduct, or failure to follow instructor guidelines may result in termination of membership without refund.
Health and Safety Protocols
SOLDIERFIT® follows all local, state, and federal health guidelines to ensure the safety of its members. Members and guests must comply with all health and safety protocols in effect, including but not limited to mask mandates, social distancing, and temperature checks. Failure to comply with health guidelines may result in suspension or termination of membership without refund.
Non-Payment Suspension
If payment is not received by the scheduled billing date, SOLDIERFIT® reserves the right to suspend membership access until payment is made. Repeated payment failures may result in termination of membership, and all unpaid balances will be subject to collection efforts as outlined in this agreement.
Equipment Responsibility
Members are responsible for using gym equipment in a safe and proper manner. Any misuse of equipment that results in damage or injury may result in the member being held responsible for repair costs or personal liability. Members are expected to report any faulty or damaged equipment immediately.
Data Protection
By registering for an account or using our services, you consent to the collection and use of your personal data in accordance with our Privacy Policy. SOLDIERFIT® uses third-party services to process your payments and manage class schedules. We are committed to protecting your personal information.
Force Majeure
SOLDIERFIT® shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, government actions, pandemic, epidemic, natural disasters, or power outages. In such cases, services may be suspended or modified without liability.
Right to Refuse Service
SOLDIERFIT® reserves the right to refuse or terminate service to any individual or member who violates these Terms, engages in inappropriate or illegal behavior, or fails to follow facility rules and policies. Refusal of service may be accompanied by termination of membership without refund.
Intellectual Property
All content, including but not limited to logos, trademarks, videos, photographs, and written materials, provided by SOLDIERFIT® is the sole property of SOLDIERFIT® and may not be used, reproduced, distributed, or exploited without prior written consent.
Social Media and Online Behavior
Members engaging with SOLDIERFIT® through social media or online forums must adhere to respectful conduct, avoiding harassment, hate speech, or inappropriate content. SOLDIERFIT® reserves the right to remove members from online communities or social media channels for violations of this policy.
Medical Conditions
By participating in SOLDIERFIT® classes, members confirm that they are physically and medically able to engage in strenuous exercise activities. Members are responsible for disclosing any medical conditions or concerns that may affect their participation. SOLDIERFIT® is not liable for any injuries or health issues arising from undisclosed medical conditions.
Indemnification
Members agree to indemnify and hold harmless SOLDIERFIT®, its employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from the member’s breach of these Terms or misuse of the facility and its equipment.
